Terms & Conditions

1. Introduction

These Website Development Terms and Conditions (the “Agreement”) govern the provision of website development services (the “Services”) by Hive Webapps (the “Developer”) to the Client (the “Client”). By accepting these terms and conditions, the Client agrees to be bound by and comply with the Agreement.

2. Payment Terms

The Client agrees to pay the Developer the total fee stated in the Proposal for the Services. The payment terms are agreed upon before starting the project. The Developer reserves the right to suspend or cancel services if payment is not received according to the agreed terms.

3. Scope of Services

The Developer will provide the Services as set out in the Proposal. Any additional services the Client requires will be subject to further Agreement between the parties and may result in additional fees.

4. Intellectual Property

The Developer retains all intellectual property rights to any code, designs, or other materials created in connection with the Services. The Client is granted a non-exclusive, non-transferable license to use the completed website for business purposes. The Client agrees not to copy, modify or distribute the website without the Developer’s prior written consent.

5. Warranties and Representations

The Developer guarantees that they will provide the Services to the Client with reasonable skill and care, according to industry standards. The Client guarantees that all the content supplied to the Developer does not infringe any intellectual property rights or any other rights of third parties.

6. Limitation of Liability

The Developer will not be liable for any loss or damage suffered by the Client arising out of or in connection with the Services. The Developer’s total liability shall be limited to the fees paid by the Client for the Services.

7. Confidentiality

The Developer and the Client agree to keep confidential all information provided to each other in connection with the Services and not to disclose it to any third party without the other’s prior written consent.

8. Termination

Either party may terminate this Agreement at any time by giving written notice to the other party. In the event of termination, the Client agrees to pay the Developer for all Services provided up to the termination date.

9. Governing Law and Jurisdiction

By choosing Indian law as the governing law, this Agreement ensures that all parties agree. Additionally, the exclusive jurisdiction of Indian courts provides a clear path for dispute resolution.

10. Entire Agreement

This Agreement constitutes the entire Agreement between the parties. It supersedes all prior agreements, understandings, or arrangements, whether oral or written.

By accepting these terms and conditions, the Client agrees to be bound by and comply with the Agreement.

At Hive Webapps, we value every project and strive to deliver it on time. Our refund policy applies if a client is unsatisfied with the project and wishes to change their plan or request a refund.

Advanced Payment Policy:

We require a 50% advanced payment before starting any project. If a client decides to cancel a project, they must inform us within two days after the advance payment. In this case, a full refund will be issued if requested within two days. After that, refunds are not available.

Refund Policy:

- Full Refund: A full refund will be given if the project has yet to be started or delivered.

- Partial Refund: The advance payment will be non-refundable if the project has already started and the client requests a cancellation.

- No Refund: No refund will be issued after the project has been delivered.

Change in Policy:

Please note that Hive Webapps reserves the right to change our policy without prior notice. Any changes made to our policy will apply to all existing and new clients.
